Commercial Real Estate – Foreclosures

I’ve been saying that the commercial real estate market is next in line to fall. The Arizona has put together a piece that discusses it and give some good insights, you can read about it here.

The question is can we afford these foreclosures?  The collapse of the residential mortgage market just about did the United States in and has help to ring up the largest deficit in this nation history.

Is government going to step in and bail commercial lenders out also?

Census Worker Demanding Entry Into Your Home

Here is a scary thought, a census worker can demand entry into a home, apartment or other dwelling unit without the consent of the tenant.  Read It Here.

As a Landlord if this happens to you I would make sure that you follow the Landlord Tenant Act to the “T”. Which in Arizona means 48 hrs notice.

Home Price Continue To Decline

The Mesa Tribune is reporting that price are still sliding even though the government has literally thrown millions of $$$$ at the problem.

So how do you deal with the problem? That is the question to be answered and frankly I don’t think anybody has the answer anymore.

Finders Fees Law Changes Arizona

Governor Brewer signed changes to the the finder fee laws for rental properties. The law now allows Landlords to offer up a finder fee of $200 five times a year to one tenant. This is an increase from the previous amount of $100 six time a year.

The tenant may not perform the following actives in regards to this finder fee:

  1. The tenant cannot show a perspective tenant a dwelling unit.
  2. The tenant cannot discuss terms or condition of renting the unit.
  3. and the tenant cannot participate in the negotiations of the lease.

New Arizona Law Protects Tenants on Foreclosed Houses

The Governor of Arizona signed into law HB2766, which is designed to protect tenants for Landlords who rents a tenant a foreclosed on house and then walks away with the tenants rent and money leaving the tenant high and dry.

The law provide language that the lease must now contain if the property is foreclosed on, it is as follows or substantial the same:

THIS PROPERTY IS UNDERGOING FORECLOSURE. FOR MORE INFORMATION ON THIS ACTION, YOU SHOULD CONTACT ________________ (NAME, ADDRESS AND PHONE NUMBER OF THE COURT WHERE THE ACTION IS FILED OR TRUSTEE, ATTORNEY OR OTHER RESPONSIBLE PARTY).

A SALE AT AUCTION MAY OR MAY NOT OCCUR AS A RESULT OF THIS FORECLOSURE. CURRENTLY, THE SALE OF THIS PROPERTY HAS BEEN SET FOR _________ (TIME, DATE AND PLACE) OR NO DATE FOR SALE OF THIS PROPERTY HAS BEEN ESTABLISHED.

Failure of a landlord to include this language give the tent the right to deliver written notice, recover damages, injunctive relief and requires that the security deposit be returned.

Fortunately or unfortunately as you see it, the laws does not apply to multifamily residential dwelling unit of 4 or more connected units.

Personally I believe that it should apply to 4 units or less connected or not.
